Hi Folks, I'm looking for people who would agree/disagree with me. I am an oap fell on hard times as is happening right now to lots of people and really nothing to do with age. I wanted to sell my flat urgently I telephoned various estate agents not committing myself to any,giving the properties location and my name in general conversation. I found out a certain EA had apparently rushed and put up a sale board without my knowledge or consent. To say the least I was a bit angry and told him so he fetched the board down, he then telephoned me to say he had found a buyer for me (all in 2 days) which honestly I was pleased about because I would be able to clear all my debts and not end up in the bankruptcy court !. EA then sent me a memorandum and also my solicitor. The sale has completed now and my solicitor paid. NOW EA has sent me a bill for £1200 plus vat, which as far as I am concerned he did nothing in terms of marketing the property whatsoever just said he had a buyer straight away. I believe there is something fishy been going on (or perhaps thats my age senility and all that lol. I did not at any stage sign a contract, never met this EA,only spoke to him a couple of times over the telephone I was desperate to sell but do not feel I should pay him all this money when it is 4 times plus what my solicitor charged and they did all the work not trying to steal a march on the EA just wanted honest opinions asap. Hi Violet
Surely if you didn't sign a contract you are not under any obligation to pay the EA!! If you haven't done so already, it would be worth you posting your question in the Solicitor/Legal section. If you don't get any replies, try having a word with your solicitor who dealt with the sale. Good luck |

If the OP didn't want a contract with the EA, she shouldn't have sold the house to the buyer the EA introduced. By accepting this buyer, and actually proceeding with the sale to a conclusion, she's tacitly accepted the EA's contract. Without the EA there would have been no sale, and by her own admission, the OP might now be in the bankruptcy court.
Again, if that's not worth £1200, what is it worth? |

I did not say I sold my property to clear the E Agents debt I said that I sold my property in order to clear other outstanding debts

I was willing to settle my E Agents costs but as I had not ever signed a contract and he had initially visited my tenanted property (me making the arrangements with my tenant etc and E -A visiting my property without a buyer (said buyer was too busy too come and view). All I ever asked for was their bill of costs which is not clear and obviously charging for things that I the seller have arranged. I have now received a summons from the court sent to the wrong address last year in 2010 my name but wrong address and redirected by a neighbour and recieved nearly 2 months later. The summonse appears to have been everywhere to other addresses etc before it reached me. I rang the court immeidately who stated that judgement had been made against me and now the charges are much higher. It is apparent that the Estate Agent initially gave their solicitors an incorrect address, who then passed it on to the court, although I have received correspondence from their solicitors this year 2011 to my CORRECT address confusing or what now waiting for a warrant to be served on me and nothing was my fault
