Default Get out of 1-year lease agreement

Hi All,

I made a mistake 8 months ago when I signed a 1-year lease for the flat we're currently living in. That's because we couldn't trust our landlady when she informed us about the condition of the flat.

The main thing is that she assured us the flat was quiet and there's hardly any noise from the street and through neighbours. Well, the busy street, ambulanc/police and party people in the neighbourhood proved so stressful that I ended up in hospital twice for sudden hearing loss.

We never complained, but in late August, we told her we wanted to look for something else from January. To be fair on her, we offered to look for successors, ie show the flat and pay for until the successor moves in.

She wasn't happy when we offered the news, agreed with what we offered, though.

Now, we were showing the flat to roughly 40 people, no one is interested and we're moving out in a week or so with no successor in sight. We also found in the meantime that our rent is totally overpriced (ie, we pay much more for less quality than our neighbours.)

What's your take here:

Would we, in a worse-case scenario need to pay until the end of the lease?
Can we make a case out of the misleading information she gave us in the first place?
Does the agreement to let us go from January mean we definitely have to pay until the end of the lease?

If you signed the leased, it's your responsibility to ensure it's seen through to completion.

While your situation is unfortunate, the law will generally look at what has been agreed in writing and work on that basis.

However, if there is a noise problem, you should seek to contact your local council enviromental health and report the problem for them to look into.
