Hi,
Unfortunately, I am having some issues with my neighbours. One of the neighbours arranged to put up a wooden door structure to block the right of way which gives access at the rear of our gardens. He collected money from some of the other neighbours who are affected and called the builder who fitted this structure. This right of way is privately owned property and does not belong to any of the neighbours. The problem I have is this door is blocking my access to part of my land, they have actually fixed it so it extends well into my land. Initially I contacted my neighbour who arranged this structure and he has flat out refused to do anything about it, saying how happy he and the other neighbours are for this added security and I shouldnt have a problem. The next step, I contacted the owner of the right of way who put me in touch with his managing agent - this agent has told me verbally that I should use a crowbar and remove it if it is a problem for me because the right of way is suppose to be kept clear. I was initially relieved to hear this but am now wondering if I can get done for vandalism if I do remove it ? And who's responsibility is it to keep the right of way clear? |
