Default NHBC WARRANTY - ACCEPTANCE NOT RETURNED - NHBC CANCELLED - Can they do this??

HELP - We were due to exchange on Friday. All our buyers needed was a copy of our NHBC Insurance Certificate. All we had was the NHBC Buildmark Cover Note issued on the date of exchange when we bought the house and the subsequent Buildmark Offer once we had moved in. We got our mortgage agreed once the cover note was received. Our solicitors accepted the offer in Feb 2007 but never received the Certificate. This was their responsibility. It states that the Buildmark Offer is binding if the NHBC builder is registered on the date of completion - he was and it is accepted by the first owner - that is us. There is no time limit. We telephoned the NHBC on Friday and they have cancelled the policy as the builder is no longer registered. He was when we exchanged. The subsequent offer we received from NHBC, as this is given after the cover note, states Seller not registered builder. Arrangement approved by NHBC.

Can they cancel a policy without notice? It means that we cannot sell our house for another 4 and a half years without NHBC cover. We are due to emmigrate to Australia after years of trying to obtain a visa, and alot of expense. PLEASE ADVISE - URGENT. THANKS.
