Hi
I'm new here and just would like to ask some advise regarding indemnity insurance that was used to cover renovation works in property that should have required planning permission but was not done by the current owner. Here are my questions: 1. Is this insurance fool proof? 2. Is this really the quick way to cover the shortcomings of the owner? Thanks |

The insurance only pays out if enforcement action is taken by the local authority, (cost of defending case, loss of value because works have to be removed) not if there is damage to the property is the works are substandard.
That's the position in England & Wales - it might be different in Scotland. As a conveyancing solicitor I believe the information given in the post to be useful but I accept no liability except to fee-paying clients. |
