I am selling a flat and have agreed with my freeholder to pay for the extension of the lease on completion as he knew I couldnt get the funds in advance
The buyers solicitor however is now insisting that the buyers mortgage lender is insisting we pay for the lease extension before completion as they say they are concerned about aquisitions If we were able to borrow the money we need to make sure there is a guarantee we complete as how can we be sure they will complete after we pay for the lease We really dont want to pay before completion Please can someone help as we are looose ends and want to complete before xmas |

There is a theoretical concern about requisitions because the buyer's solicitor has no control over the registration of the lease extension as he is not responsible for it. However in the real world this concern is more theoretical than real and provided a buyer's solicitor checks everything it should be OK.
The problem your solicitor has is convincing buyer's solicitor of this. If he won't accept the position, he won't accept it and that's that.

We have told today the buyers solicitor can be awkward and our solicitor is having problems trying to speak him on the phone I think he is avoiding calls If you have any suggestions regards |
