Default Swapping Estate Agents potential issue

Not sure if anyone has any advice on this situation.

We've been with estate agent A for a few months and not happy with the service so put in our notice period and set to change to estate agent B on Saturday.
However we had a viewing today which also are having a second viewing tomorrow and seem very interested. But with the cross-over day coming up what is the best thing to do as I don't want to end up paying 2 sets of fees?
Is it likely that agent B would delay for a week before taking over even though we signed documents?

If the cross over period is after the second viewing, I'd suggest you ask your current agent to withhold sending out the memorandum of sale until a few days after you are clear of the cross over. And date it later too.

You will already have a contract with agent A; read it carefully but it will have wording along the lines of an introduction made, and no doubt what happens after the contract time to market has finished. If a sale results 99.9999% of the time Agent A will be entitled to their commission either post exchange or completion.

If a second agent has been instructed, then its down to whatever you have signed, so be it a legal contract, and worded content. Make sure you make Agent B fully aware that any previous introductions are between you and the previous agents 100% and that should a previous applicant buy, then no commission will be further payable away from Agent A. I would recommend all communications in writing, and make sure Agent B will release you and not sting you should Agent A's buyers buy.

Be sure that Agent A are not stalling you, as potential buyers could keep being found, that in the end go no where.

Don't get caught in a dual commission due situation.

If unsure, discover whether your agent is a RICS SOS or TPOS member and consult their ombudsman for guidance. Agents must show fair transparent practice under ombudsman code and most play fair. Trevor Mealham (INEA) The Independent Network of Estate Agents
