Whats the extent of caveat emptor?
When selling a property how much information, if any, is one obliged to disclose, without being asked?
For example, I own a flat on a housing association estate. I have reported several repairs in the common areas and gardens, as well as their being a list of outstanding repairs. Also, there was a problem with youths and children loitering in common areas, quite near to my flat, although this is a lot rarer now. Am I obliged to disclose anything at all about the common parts, or historical things, or is it a case of caveat emptor?

You will be sent a Property Information or similar form by your solicitors and you have to answer the questions to the extent of your knowledge. You can of course say that you do not want to answer particular questions but any buyer's solicitor is going this is really odd and will press for answers.
It is almost certain that you will have to mention the issues about the repairs but the youths etc loitering will depend on the precise wording of the questions involved.
